1. Introduction

1.1 Welcome to Neshima, a Jewish meditation platform intended to help people meditate in a Jewish framework and reconnect with themselves and with Jewish spiritual and meditative practices and traditions.

1.2 These terms of use and conditions (the "Terms") govern your access to and use of the Neshima meditation platform (the "platform") and all the content, services, and features made available on the platform, including but not limited to recorded guided meditations, meditation resources, and a meditation timer (collectively, the "Services").

1.3 By accessing or using the Neshima platform and related services (collectively, "Neshima" or the "Services"), you agree to be bound by these Terms of Use and Conditions ("Terms"). If you do not agree to all of the terms and conditions contained in these Terms, do not use Neshima.

1.4 Please read these Terms carefully before using the platform. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the platform.

    2. Pricing and Payment

2.1 The platform is available for free during the period of the Beta testing. 

2.2 The ending date of the Beta testing period is not yet determined.  

2.3 After the Beta testing period ends, the platform will no longer be free. 

2.4 Neshima reserves the right to terminate or suspend your account at any time for any reason, including but not limited to violation of these Terms or inappropriate behavior.

​    3. Intellectual Property

3.1 The content provided through Neshima, including but not limited to text, graphics, images, and audio recordings, is protected by copyright and other intellectual property laws. You may not use any content provided through Neshima for any commercial purpose without the express written permission of Neshima.

3.2 You may not reproduce, distribute, modify, or create derivative works of the content provided through Neshima without the express written permission of Neshima.

    4. Privacy Policy

4.1 We respect your privacy and are committed to protecting your personal data. Our privacy policy, which is available on the platform, explains how we collect, use, and share your personal data when you use the platform. By using Neshima, you agree to the collection, use, and sharing of your information as described in our Privacy Policy.

4.2 By using Neshima, you agree to receive newsletters and other emails from Neshima. You may unsubscribe from these emails at any time by following the instructions in the emails.

 

    5. Disclaimer of Warranties

5.1 The platform and the Services are provided on an "as is" and "as available" basis. We do not warrant that the platform or the Services will be error-free or uninterrupted.

5.2 Neshima is still in development and may not be fully functional or stable. There may be bugs and issues with the Services. By using Neshima, you acknowledge that you are using a beta version of the platform and agree to use the Services at your own risk.

5.3 We do not provide any warranties of any kind, express or implied, regarding the platform or the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

    6. Disclaimer of Liability

6.1 The Services provided by Neshima are for educational and informational purposes only. Neshima is not a substitute for professional medical advice, diagnosis, or treatment and should not be relied upon as such.

6.2 We will not be liable for any damages of any kind arising from your use of the platform or the Services, including but not limited to direct, indirect, incidental, consequential, and punitive damages.

6.3 The platform is intended to help users meditate and reconnect with themselves and with Jewish spiritual and meditative practices and traditions. However, we do not make any representations or warranties about the effectiveness of the platform or the services. 

6.4 Neshima is not responsible for any errors or omissions in the content provided through the Services. Neshima is not liable for any damages or losses you may incur as a result of using the Services.

7. Governing Jurisdiction 

7.1 These Terms and your use of Neshima are governed by the laws of the State of Israel.
